AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE BY CODIFYING CERTAIN SECTIONS OF THE FISCAL YEAR 2002 BUDGET ACT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend 7 Del. C. §6097 (i) by inserting the phrase, “, shall be interest earning,” after the word “title” and before the words “and shall”:
Section 2. Amend 7 Del. C. § 6005 by adding the following phrase to the end of the last sentence in subsection (d):
“, however any expenditure or transfer must be approved by the State Budget Director and the Controller General. The department shall submit quarterly reports on the progress of the expenditures and/or projects. All expenditures must be recommended by the department and approved by the Secretary. All penalty funds will be deposited in the Penalty Fund Account. All of the penalty fund expenditures made by the Department of Natural Resources and Environmental Control shall be reported annually to the Joint Finance Committee in the department’s annual budget presentation. Included in this presentation shall be an explanation of the process used to select the recipients of Penalty Fund money.”
