AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO HIGHER EDUCATION INCENTIVES FOR STUDENT ACHIEVEMENT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §3404(d), Title 14, Delaware Code, by inserting the following sentence after the first sentence:
"Performance in the Delaware State Testing Program shall be considered as a factor in determining academic merit for the purposes of awarding this scholarship. The Higher Education Commission, after consulting with the Secretary of Education, shall consider alternative measures of student performance in the core academic subjects covered by the Delaware State Testing Program for non-public school students who apply for this scholarship; provided, however, that such measures shall be determined by the Commission to be equally rigorous, valid, and reliable measures of student achievement and further provided that nonpublic schools are encouraged to administer the Delaware State Testing Program to their students who desire state financial aid assistance."
Section 2. Amend §3482(d), Title 14, Delaware Code, by inserting the following sentence after the first sentence:

Section 3. Amend §3443(d), Title 14, Delaware Code, by inserting the following sentence after the first sentence:
"Performance in the Delaware State Testing Program shall be considered as a factor in determining academic achievement for the purpose of awarding this scholarship.

Section 4. This Act shall become effective when results of the Delaware State Testing Program are available for consideration by the Higher Education Commission in awarding scholarships.
