AN ACT TO AMEND THE CHARTER OF THE TOWN OF SOUTH BETHANY, CHAPTER 268, VOLUME 69, LAWS OF DELAWARE, AS AMENDED, ENTITLED "AN ACT TO REINCORPORATE THE TOWN OF SOUTH BETHANY" TO MODIFY THE AUTHORITY OF THE TOWN COUNCIL TO COMPEL CONNECTION TO THE WATER SYSTEM OF THE TOWN, SAID PROVISION TO BE SUBJECTED TO A PUBLIC REFERENDUM EXCEPT IN EMERGENCY.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. The last paragraph of Section 20, Water Systems, of Chapter 268, Volume 69, be and is hereby amended by striking said paragraph in its entirety and substituting in lieu thereof the following:
"Properties may be compelled to connect to a Town water system based on a determination by a Town referendum, except in an emergency condition in which the Town Council must decide so as to protect the public's health and welfare."
