SENATE BILL NO. 372
AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO THE TRAPPING OF ANIMALS AND THE HUNTING OF RACCOONS AND OPOSSUMS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §705, Title 7, Delaware Code, by striking the word "penalty" from the title of said section and substituting in lieu thereof the phrase "killing of trapped animals".
Section 2. Amend
§705, Title 7, Delaware Code by striking the second sentence thereof, designating the first sentence as subsection (a) and by adding thereto a new subsection to read as follows:
"(b) Notwithstanding § 704(d) of this title, a .22 caliber rimfire pistol may be
used to kill animals lawfully confined or restrained by a trap or snare."
Section 3. Amend § 786, Title 7, Delaware Code, by adding thereto a new subsection to read as follows:
"(e) Notwithstanding § 704(d) of this title, a .22 caliber rimfire pistol may be used to hunt raccoons and opossums."
