AN ACT TO AMEND CHAPTER 295. VOLUME 65, LAWS OF DELAWARE, AS AMENDED, ENTITLED "AN ACT TO REINCORPORATE. THE TOWN OF BETHANY BEACH" RELATING TO THE QUALIFICATIONS FOR NONRESIDENT PROPERTY OWNERS TO HOLD PUBLIC OFFICE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE 01 DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend § 5.2.2(b). Chapter 295, Volume 65, Laws of Delaware, as amended. by deleting the first sentence thereof and substituting in lieu thereof the following:
Any person who, on the date of filing of the notice of intention to run (or on the date of his or her appointment to office in the case of a vacancy), is not a resident, but is a freeholder in the town and otherwise qualities to serve on the Town Council, shall be deemed to be a "non-resident" member of the Town Council."
