AN ACT TO AMEND CHAPTER 41, TITLE 21 OF THE DELAWARE CODE RELATING TO REMOVAL AND STORAGE OF VEHICLES FROM HANDICAPPED PARKING AREAS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend subsections (c) and (d), Section 4183, Chapter 41, subchapter XI, Chapter 41, Title 21, Delaware Code by redesignating said subsections as new subsections (d) and (e) respectively and substituting in lieu thereof a new subsection to read as follows:
"(c) Upon discovery of a vehicle other than a vehicle of the handicapped, in a designated handicapped parking/tow-away zone by owners/lessees of private property, the owner/lessee may cause such vehicle to be removed to a private storage area maintained for the safe storage of vehicles. Any costs of removal and storage shall be borne by the owner of said vehicle. Upon discovery of such a vehicle, in a designated handicapped parking/tow-away zone under the control of the Department of Transportation or local authorities, the State Police, county police or municipal police may, if they determine the circumstance requires such, cause such vehicle to be removed to a private storage area maintained for the safe storage of vehicles. Any costs of removal and storage shall be borne by the owner of said vehicle."
