AN ACT TO AMEND CHAPTER 17, TITLE 24 OF THE DELAWARE CODE ADOPTING THE UNIFORM DETERMINATION OF DEATH ACT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend Chaptcr 17, Titlc 24 of the Dclawarc Codc by adding a new Scction 1760 thcrcto to rcad as follows:
"§1760. Dctcrmination of Death
(a) An individual who has sustaincd cithcr:
(1) Irrevcrsiblc ccssation of circulatory and respiratory functions, or
(2) Irrcvcrsiblc ccssation of an functions of thc entire brain, including thc brain stcm, is dcad. A detcrminatinn of death must be madc in accordance with acceptcd mcdical standards.
(b) This scction shall be applicd and construcd to cffcctuale its gcncral purposc to makc uniform the law with rcspcct to thc subject of this scction among statcs enacting it.
(c) This scction may be citcd as thc Uniform Dctcrmination of Dcath Act."
