AS AMENDED BY HOUSE AMENDMENT NO. 2
AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO THE PLANNING BOARD OF NEW CASTLE COUNTY.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §1342, Subchapter III, Chapter 13, Title 9 of the Delaware Code by striking said Section in its entirety and substituting in lieu thereof the following:
"§l342, Planning_iloard
(a) The Planning Board shall consist of seven members who shall serve without compensation. The County Executive, with the advice and consent of the County Council, shall appoint six members who shall serve for terms of three years, provided that the terms of two members shall expire each year, one term to expire on January 31, and one term to expire on July 31.
(b) The County Executive, with the advice and consent of the County Council, shall appoint one member who shall be chairman and who shall serve at the pleasure of the County Executive.
(c) No person shall serve as a member of the Board for more than six consecutive years, provided that no individual who has previously been appointed to a term of less than three years shall be precluded from thereafter being appointed to serve for up to six more consecutive years.
(d) No person who has served on the Board for six or more consecutive years shall be appointed to an additional term until the expiration of three years from the date on which he ceased to serve as a member of the Board."
Section 2. This Act shall become effective upon its enactment into law, provided, however, that any member presently serving an unexpired term on the New Castle County Planning Board shall continue to serve until said term expires. In order that the terms of members appointed to the New Castle County ounty Manning Board hereafter may be staggered in accordance with the terms of Section 1 above, such members shall be appointed to fill terms which shall expire on the following dates:
1) January 31, 1987;
2) July 31, 1987;
3) January 31. 1988;
4) July 31, 1988;
5) January 31, 1989; and
6) July 31. 1989.
