AN ACT TO AMEND CHAPTER 69, TITLE 29, DELAWARE CODE, RELATING TO THE AWARD OF CONTRACTS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §6907. Title 29, Delaware Code, by Inserting between the first and second sentence thereof the following:
"In determining how the Interest of the State or contracting county is better served in making an award to other than the lowest responsible vendor, the agency may take Into consideration unsatisfactory performances on any previously awarded contract by the vendor being rejected."
