AN ACT TO AMEND SUBCHAPTER III, CHAPTER 79, TITLE 29, DELAWARE CODE, RELATING TO FINANCIAL LIABILITY OF PERSONS SERVED BY THE DEPARTMENT OF HEALTH AND SOCIAL SERVICES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §7940 (c), Chapter 79, Title 29, Delaware Code, by striking the period (.) at the end of said subsection and inserting in lieu thereof the following:
": provided, however, that such rules and regulations limit the financial liability of a spouse, parents, or children to no more than 10 percent of his or her annual disposable income in any 12 month period of care or treatment.
