AN ACT CONCURRING IN A PROPOSED AMENDMENT TO ARTICLE IV OF THE CONSTITUTION OF THE STATE OF DELAWARE RELATING TO THE JURISDICTION OP THE SUPREME COURT.

WHEREAS, an amendment to the Constitution of the State of Delaware was proposed in the 131st General Assembly, being Chapter 325, Volume 63, Laws of Delaware as follows:

"AN ACT PROPOSING AN AMENDMENT TO ARTICLE IV OF THE CONSTITUTION OF THE STATE OF DELAWARE RELATING TO THE JURISDICTION OF THE SUPREME COURT.

BE IT ENACTED BY THE GENERAL ASSEMBLY OP THE STATE OP DELAWARE (Two-thirds of all members elected to each Howe thereof concurring therein)

Section 1. Section 11, Article IV of the Constitution of the State of Delaware is amended by deleting subsection (9) thereof and inserting in lieu thereof the following subsection (9):

"(9) To hear and determine questions of law certified to It by other Delaware Courts and the United States District Court for the District of Delaware where it appears to the Surpeme Court that there are important and urgent reasons for an immeidate determination of such questions by it. The Supreme Court may by rules define generally the conditions under which questions may be certified to it and prescribe methods of certification:1 and

WHEREAS, the said proposed amendment was agreed to by two-thirds of all members elected to each House in said 131st General Assembly.

NOW, THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each House thereof concurring therein)

Section 1. The said proposed amendment is agreed to and adopted and shall forthwith become a part of the Constitution of the State of Delaware.

Effective June 30, 1983.
