AN ACT TO AMEND TITLE 16, PART I, DELAWARE CODE, BY CREATING A NEW CHAPTER TO BE DESIGNATED AS CHAPTER 2, TO PROVIDE ASSISTANCE TO CHILDREN WITH LONG-TERM BIRTH DEFECTS WHO ARE NOT COVERED UNDER EXISTING PROGRAMS AND PROVIDING A SUPPLEMENTAL APPROPRIATION TO IMPLEMENT THE PROVISIONS OF THIS ACT.
Be it enacted by the General Assembly of the State of Delaware:
Section 1. Title 16, Part 1, Delaware Code, is hereby amended by adding a new Chapter to be designated as Chapter 2 to read as follows:
"CHAPTER 2. LONG TERM BIRTH DEFECTS TREATMENT PROGRAM
§201. This Chapter shall be known as the Long-Term Birth Defects Treatment Program.
The cost of treatment for long-term birth defects can be prohibitive and can impose substantial burden upon the victim's family which may not be able to be met by the resources of that family, and the State, federal or private agency resources. The treatment of such child is in the best interest and welfare of the people and the State of Delaware and it is the intent of this Act to provide assistance with the cost of treatment for children so afflicted.
Treatment paid for under this program shall be provided insofar as possible within the State of Delaware. The Secretary of the Department of Health and Social Services will establish rules and regulations for the eligibility of persons requesting services under this Chapter, as well as ability to pay for such services and for the disbursement of such funds herein or hereafter appropriated for this program. Further, this Act will in no way affect the rights and/or liabilities or duties of the Secretary of the Department of Health and Social Services, or persons or guardian of persons requesting services under this Act, from operation of laws of prior existing laws and, in particular, §7940, Title 29, Delaware Code."
Section 2. The sum of $20,000 is hereby appropriated to the Department of Health and Social Services to be expended for the implementation of this Act. This appropriation shall be considered as a supplementary appropriation and shall be paid by the State Treasurer from funds not otherwise appropriated.
Section 3. Any funds not expended as of June 30, 1975, shall revert to the General Fund.
Section 4. This Act shall take effect upon the signature of the Governor.
