AN ACT TO GRANT APPROVAL TO THE DEPARTMENT OF NATURAL RESOURCES AND ENVIRONMENTAL CONTROL TO PURCHASE SIX PARCELS OF LAND WITHIN LUMS POND STATE PARK, PENCADER HUNDRED, NEW CASTLE COUNTY, KIRKWOOD, DELAWARE.
WHEREAS, pursuant to the 1973-74 Capital Improvement Act, being Chapter 223, 59 Laws of Delaware, Section 19, the Department of Natural Resources and Environmental Control is prohibited from purchasing any land in excess of $50,000 without prior approval by the General Assembly; and
WHEREAS, the Department of Natural Resources and Environmental Control have taken steps to create a major recreation area to serve the residents of the State known as Lums Pond State Park; and
WHEREAS, six (6) parcels of land and improvements totaling approximately 113 acres with an estimated value of $376,500 are inholdings within Lums Pond State Park which will jeopardize the development of recreational activities in compliance with the park master plan; and
WHEREAS, the six parcels are known as the Hodson property,15+ acres without improvements; Woerner property, 40+ acres with improvements; Doud property, 7+ acres with improvements; Brennan property, 22 + acres without improvements; Konkiel tract, 2+ acres with improvements; and Camac property, 26 + acres without improvements; and
WHEREAS, the cost of purchasing the parcels are eligible for 50% Federal matching funds from the Land and Water Conservation Fund Act administered by the U.S. Bureau of Outdoor Recreation; and
WHEREAS, the purchase price will be based on appraisals prepared by professional fee appraisers and the acquisition shall be in compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 91-646) and Title 29, Chapters 91 and 92 of the Delaware Code entitled Uniform Relocation Assistance and Real Property Acquisition.
Be it enacted by the General Assembly of the State of Delaware:
Section 1. The Department of Natural Resources and Environmental Control is hereby granted approval by the 128th General Assembly of the State of Delaware, pursuant to Chapter 223, 59 Laws of Delaware, Section 19 to acquire six parcels of land and improvements known as Woerner property, Doud property, Brennan property, Konkiel tract, Hodson property and Camac property within Lums Pond State Park situated in Pencader Hundred, New Castle County, near Kirkwood, Delaware.
Section 2. Said purchase shall be made in compliance with Title 29, Chapters 91 and 92, Delaware Code and P.L. 91-646, Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970.
Section 3. The purchase price shall be matched with Federal Land and Water Conservation Funds to the fullest extent possible.
