AN ACT TO AMEND CHAPTER 39 OF TITLE 7, DELAWARE CODE, RELATING TO THE SPECIFICATION OF SEDIMENT REMOVAL AS AN ELEMENT OF CONSERVATION, PROTECTION, DEVELOPMENT AND UTILIZATION OF LAND AND WATER RESOURCES.
Be it enacted by the General Assembly of the State of Delaware:
Section 1. Amend §3905(a)(1) of Chapter 39, Title 7, Delaware Code, by striking the semicolon (;) immediately following the word "v, ater" and insert the following:
", and removal of sediment from waterways, lakes, ponds or other bodies of water; " .
Section 2. Amend §3905 (a) (3) of Chapter 39, Title 7, Delaware Code, by striking the period (.) immediately following the word "water" and insert the following:
", and removal of sediment from waterways, lakes, ponds or other bodies of water;".
Section 3. Amend §3905(b)(3) of Chapter 39, Title 7, Delaware Code, by striking said paragraph (3) in its entirety and substituting a new paragraph (3) to read as follows:
"(3) Conduct surveys, investigations and research relating to erosion, floodwater and sediment damages, and to the conservation, protection, development and utilization of land and water resources, including impoundment and disposal of water, and removal of sediment from waterways, lakes, ponds or other bodies of water, and the prevention and control measures and works of improvement needed; publish the results of such surveys, investigations and research; disseminate information concerning such preventive and control measures and works of improvement; except that any agricultural research shall be in cooperation with the Delaware Agricultural Experiment Station;".
Section 4. Amend §3905(b)(4) of Chapter 39, Title 7, Delaware Code, by striking the semicolon (;) immediately following the word "water" and insert the following:
", and removal of sediment from waterways, lakes, ponds or other bodies of water;".
Section 5. Amend §3908(1) of Chapter 39, Title 7, Delaware Code, by inserting immediately after the phrase "of water" the following:
"and removal of sediment from waterways, lakes, ponds or other bodies of water".
