AN ACT MAKING A SUPPLEMENTARY APPROPRIATION TO THE DIVISION OF SOCIAL SERVICES OF THE DEPARTMENT OF HEALTH AND SOCIAL SERVICES FOR THE PURPOSE OF PAYING A PURCHASE OF CARE AGREEMENT MADE BY THE DIVISION OF SOCIAL SERVICES WITH THE MURPHEY SCHOOL ON JUNE 30, 1972.
WHEREAS, on June 30, 1972, the Division of Social Services erred in placing four girls in the Murphey School on June 30, 1972, on a Purchase of Care Agreement; and
WHEREAS, the Purchase of Care Agreement occurred prior to the Court of Chancery rendering its final decision regarding the integrating of the Murphey School; and
WHEREAS, the Secretary of the Department of Health and Social Services agrees that the Division of Social Services erred in placing the children in the Murphey School so long as it was segregated; and
WHEREAS, under law a State agency cannot use funds appropriated for the current year to pay obligations incurred in prior fiscal years:
Be it enacted by the General Assembly of the State of Delaware:
Section 1. The sum of $10,503.00 is hereby appropriated to the Division of Social Services, Department of Health and Social Services, for the purpose of paying a Purchase of Care Agreement made by the Division of Social Services with the Murphey School on June 30, 1972.
Section 2. This is a supplementary appropriation and the funds hereby appropriated shall be paid by the State Treasurer out of funds in the General Fund of the State of Delaware not otherwise appropriated.
Section 3. The funds herein appropriated remaining unexpended or unencumbered on June 30, 1976, shall revert to the General Fund of the State of Delaware.
