AN ACT TO AMEND SECTION 13, PARAGRAPH 13 OF THE CHARTER OF THE CITY OF HARRINGTON TO PERMIT THE CITY OF HARRINGTON TO LEVY A SEPARATE GARBAGE FEE.
Be it enacted by the General Assembly of the State of Delaware (two-thirds of all the members elected to each branch thereof concurring therein):
Section 1. Amend Section 13, Paragraph 13 of the Charter of the City of Harrington by adding thereto the following new subparagraph to read as follows:
"In addition to the tax rate as aforesaid, should the Council award an annual contract for garbage collection or provide for the collection of garbage by some other means, the Council may levy, assess and collect a garbage collection fee based upon the reasonable value of the service provided. The garbage collection fee for each 'garbage collection unit' shall be levied, assessed and collected at the same time and in the same manner as the regular annual property tax for each `garbage collection unit' pursuant to the City Charter and shall be placed on the annual tax bill for each 'garbage collection unit' as a separate item. For purposes of this paragraph, each parcel of real property located in the City of Harrington which is improved and intended for residential use is a 'garbage collection unit'."
Section 2. This Amendment to the Charter shall be filed with the Secretary of State and with the Director of the Legislative Council (formerly Legislative Reference Bureau) pursuant to the provisions of §836, Title 22, Delaware Code.
