AN ACT TO RESTORE FUNDS ELIMINATED FROM THE F.Y. 1976 BUDGET OF THE PUBLIC SERVICE COMMISSION FOR ITS REGULATORY OPERATIONS.
WHEREAS, the Public Utilities Act of 1974, enacted on June 28, 1974, provides for the funding of the operations of the Public Service Commission from a Regulatory Revolving Fund derived from a 2 (.002) mills annual assessment of utility operating revenues to be paid into the fund on or before April 1st of each year; and
WHEREAS, said assessments have been deposited in the fund; and
WHEREAS, the Public Service Commission requires those funds that were eliminated from its FY 1976 Budget Request (approximately 18% of the budget) to perform its regulatory functions;
Be it enacted by the General Assembly of the State of Dela ware:
Section 1. There is hereby authorized to be expended from the Public Service Commission Regulatory Revolving Fund the sum of $71,167 in addition to those funds authorized in the approved Budget for its operations to June 30, 1976 in accordance with the provisions of Section 116, Chapter 1, Public Service Commission, Title 26, Delaware Code.

(1) These charges for services shall be reimbursed by the Public Utility for whom they are performed in preparation for the Rate Case Hearings and/or Special Investigations.
(2) Approximately $1,500 of this requested restoration of funds is needed to send the Director and the Auditor of the Public Service Commission to a National Association of Regulatory Commissioners Training Course as authorized by the Commission.
(3) These funds are required to replace and supplement furnishings and equipment acquired in 1950.
