AN ACT TO AMEND PART TWO, CHAPTER 11, TITLE 15, DELAWARE CODE RELATING TO REGISTRATION DATES IN THE ELECTION DISTRICTS.
Be it enacted by the General Assembly of the State of Delaware:
Section 1. Amend Part Two, Chapter 11, Title 15, Delaware Code by striking all of the first sentence of Section 1104, starting with the words, "Registration officers for each respective election district" and substituting in lieu thereof the following first sentence:
"Registration officers for each respective election district shall sit for the purpose of ascertaining and registering the persons who are qualified to enjoy the right of an elector in such respective election district and who apply in person for registration, and whose names do not already appear as qualified voters on the registration records for such election district, at the place or places that have been selected and designated for the purpose of registration for such election district from 10:00 a.m. until 7:00 p.m on the second Saturday in October during a General Election Year."
Section 2. Amend §2002, Title 15, Delaware Code by striking said Section in its entirety and substituting in lieu thereof a new §2002 to read as follows:
"§2002. Conduct of mobile registration.
The department for each county shall conduct mobile registration throughout its county on a regularly scheduled basis at least until the second Saturday in October of each election year. Beginning with the 1978 election year, mobile registration shall start no later than May 1 of each election year. During the days and hours set for mobile registration, each department shall cause its traveling registration officers to sit either in mobile units or in other convenient, public locations. These locations shall be public gathering places, shopping center, public locations. These locations shall be public gathering places, shopping centers, public and community buildings and similar places easily accessible to and regularly visited by the general public. In assigning these locations, each department shall distribute the services of its traveling registration officers as equitably as possible throughout its county, so as to make mobile registration readily available to residents of all portions of its county. It shall regularly give due public notice of the visits of these traveling registration officers and shall so schedule these visits that the officers shall sit in each senatorial district of the county during the 30 days immediately preceding the last day for voter registration."
Section 3. That portion of the appropriations made to each county Department of Elections for Fiscal Year beginning July 1, 1976 and ending June 30, 1977 that would have been utilized for the conduct of voter registration in the several election districts on July 24, 1976, shall be transferred to each department's line item appropriation for mobile registration.
