Be it enacted by the General Assembly of the State °I Delaware:
AMEND Chapter 7, Title 21 of the Delaware Code by adding a new subsection (b) to §703 to read as follows:
"(b) Notwithstanding the above, the arresting officer may, in his discretion, issue a summons to the person arrested for appearance at a subsequent date at the Justice of the Peace Court which is the nearest available Justice of the Peace Court to the place of the arrest. For the purpose of this section, the summons for later appearance at the nearest available Justice of the Peace Court to the place of arrest, during the regularly scheduled hours of said court, shall be sufficient to grant jurisdiction over the offense charged to the said nearest available Justice of the Peace."
FURTHER AMEND §703 by redesignating subsections (b), (c), (d), and (e) thereof to be respectively subsections (c), (d), (e) and (f) thereof.
