CHAPTER 70 - STATE SUPPLIES - PROVIDING ANY STATE AGENCY MAY CONTRACT FOR FEDERAL

SURPLUS MATERIALS WITHOUT ADVERTISING FOR BIDS

AN ACT TO AMEND CHAPTER 7 OF THE REVISED CODE OF DELAWARE, 1935, RELATING TO STATE SUPPLIES, BY PROVIDING THAT ANY STATE AGENCY MAY CONTRACT WITH ANY FEDERAL AGENCY FOR SURPLUS MATERIALS WITHOUT ADVERTISING FOR BIDS THEREFOR.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 7 of the Revised Code of Delaware, 1935, be and the same is hereby amended by adding a new Section thereto to be known as 252A. Sec. 6A., as follows:

The provisions of this Chapter, insofar as they may require any State Agency, Board, Department or officers to advertise for bids and award contracts for supplies to the lowest bidder, shall not apply to contracts entered into by any such Agency, Board, Department or officers with the Federal Government, or any branch or agency thereof, for the acquisition or purchase of surplus federal commodities, supplies or materials.

The Secretary of State is hereby designated as the negotiating and/or purchasing agent, for any such State Agency, Board, Department or officers, for the acquisition or purchase of surplus federal commodities, supplies or materials from the Federal Government or any branch or agency thereof, and the cost price thereof shall be charged against the appropriations made to, and paid by the State Treasurer upon warrants issued by, the particular State Agency, Board, Department or officers for whose use such purchases were made.
