CHAPTER 71 - STATE SUPPLIES EXEMPTING PUBLIC AGENCIES FROM COMPETITIVE BIDDING ON FEDERAL SURPLUS MATERIALS

AN ACT EXEMPTING PUBLIC AGENCIES FROM COMPETITIVE BIDDING AND OTHER REQUIREMENTS ON ALL PURCHASES OF SURPLUS PROPERTY FROM THE FEDERAL GOVERNMENT.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. Definitions:--Whenever used in this act, unless a different meaning clearly appears from the context:

(a) "Public Agency" means the State of Delaware; cities, all towns, counties, and all other municipal or public corporations created by or under authority of any state statute or any department, officer or agency of any of the foregoing.

(b) "Federal Government" shall include all departments, offices or agencies thereof and any corporation controlled by any of the foregoing.

Section 2. Purchases from the Federal Government:--The provisions of any statute prescribing the legal procedure for purchases of property by any public agency shall not apply to any purchases by any public agency from the Federal government.

Section 3. Effective Date ..--This Act shall take effect immediately.
