CHAPTER 97 - STATE BOARD OF WELFARE MERGING COMMISSION FOR AID TO DEPENDENT CHILDREN AND STATE BOARD OF WELFARE

AN ACT TO AMEND CHAPTER 41 OF THE REVISED CODE OF DELAWARE, 1935, AS AMENDED, ENTITLED "STATE BOARD OF CHARITIES" AND TO AMEND CHAPTER 39 OF THE REVISED CODE OF DELAWARE, 1935, AS AMENDED, ENTITLED "MOTHERS PENSION COMMISSION", BY MERGING THE SAID BOARD AND COMMISSION INTO A NEW BOARD TO BE CALLED THE STATE BOARD OF WELFARE.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That from and after the passage of this act the State Board of Welfare (formerly State Board of Charities) and the Commission for Aid to Dependent Children (formerly Mothers Pension Commission) shall be merged and as so merged shall be designated the State Board of Welfare.

Section 2. The State Board of Welfare as herein constituted shall have all the rights and powers and all the duties and obligations heretofore created which are vested in or imposed upon the State Board of Welfare as heretofore constituted and which are vested in or imposed upon the Commission for Aid to Dependent Children as heretofore constituted. All appropriations heretofore *(*so enrolled) are hereafter made to the State Board of Welfare as heretofore constituted and to the Commission for Aid to Dependent Children as heretofore constituted, shall inure to the benefit of the State Board of Welfare as herein created.

Section 3. The State Board of Welfare except as hereinafter provided shall consist of 12 persons, three from each county and three appointed at large, all of whom shall serve without pay except for traveling expenses actually incurred in the work of the Board. The present members of the State Board of Welfare as heretofore constituted and the present members of the Commission for Aid to Dependent Children as heretofore constituted, shall continue in office as members of the State Board of Welfare as herein established until their respective terms shall expire. When the membership of the State Board of Welfare as herein constituted has been reduced to twelve members by death, resignation, expiration of term or otherwise, the Governor shall appoint successors to fill all vacancies caused by the expiration of the terms of the present and future members of the Board. All members of the Board hereafter appointed shall be appointed for a term of three years commencing July 1 of the year in which appointed, provided, however, that the terms of office of those new appointees who succeed any present incumbents whose terms expire at any time other than June 30 of any year shall expire three years from the 30th day of June of the year in which appointed. In case of a vacancy caused by death, resignation, refusal to serve or otherwise, the Governor shall make appointments to fill such vacancy or vacancies for the balance of the unexpired term. Those members who are to be resident members of the respective counties shall be so designated by the Governor in their appointment and upon making said appointments, the Governor shall so certify the fact to the Secretary of State and to the appointees.

Section 4. All acts or parts of acts inconsistent with the provisions of this act are hereby repealed to the extent of such inconsistencies.

Section 5. This Act shall become effective July 1, 1945.
