CHAPTER 156 - MUNICIPAL ELECTIONS DELIVERY OF CERTIFICATES, TALLY SHEETS AND POLL LISTS, BY ELECTION OFFICERS IN CITY OF WILMINGTON

AN ACT TO AMEND CHAPTER 727, VOLUME 19, LAWS OF DELAWARE, 1893, ENTITLED, "AN ACT IN RELATION TO MUNICIPAL ELECTIONS TO BE HELD IN THE CITY OF WILMINGTON", BY PROVIDING A METHOD FOR THE DELIVERY OF CERTIFICATES OF ELECTION, TALLY SHEETS AND POLL LISTS, BY THE ELECTION OFFICERS FOR SUCH ELECTIONS.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 727, Volume 19, Laws of Delaware, 1893, be and the same is hereby amended by repealing all of Section 22. thereof and by substituting in lieu thereof a new Section 22. as follows:

Section 22. At or before the hour of ten o'clock in the forenoon on the first Monday after the City election, the Inspector for each election district in said City shall deliver to the Department of Elections for New Castle County, at its office, the statement directed to it, and he shall at the same time deliver to the Mayor, at his office, the statement directed to him; the Minority Judge for each election district in the said City, shall at the said time, deliver to the Clerk of Council, at his office, the statement directed to him. The Inspector shall at the aforesaid time also deliver to the Department of Elections the tally sheet addressed to it; and the Minority Judge shall at the aforesaid time deliver to the Clerk of Council, the tally sheet directed to him. And it shall be the duty of the President of the Department of Elections and its Secretary, and the Clerk of the Council, and of the Mayor to be present in their respective offices from the time of closing the polls until twelve o'clock midnight of the day of the election, and from the hour of eight o'clock to the hour of ten o'clock in the forenoon of the first Monday after the election. In case for any cause the Clerk of the Council shall fail to attend at such time and place, the President of Council shall attend and receive, take charge of and safely keep said statements and tally's until delivered to the Clerk of Council, or to the Council at its next stated meeting; and if, for any cause, the Mayor shall fail to attend at such time and place, the statement shall be delivered to such person as the Mayor shall authorize to receive such statement, who shall take charge of and safely keep said statement until delivered to the Mayor.

Section 2. That Section 23, Chapter 727, Volume 19, Laws of Delaware, 1893, be and the same is hereby repealed and a new Section 23. substituted in lieu thereof as follows:

Section 23. The poll lists kept at such election shall be certified in writing by both poll clerks to be a true and correct list of the votes cast at the said election in their respective election districts, and shall be placed in the ballot box and returned with the ballots.

Section 3. All Acts or parts of Acts inconsistent with the provisions of this Act are hereby repealed.
