CHAPTER 179 - MAGNOLIA
AN ACT TO AMEND CHAPTER 568, VOLUME 17, LAWS OF DELAWARE, ENTITLED "AN ACT TO INCORPORATE THE TOWN OF MAGNOLIA BY CHANGING THE TIME AND DATE OF HOLDING ANNUAL ELECTION".
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met (two-thirds of the members elected to each House of the Legislature concurring therein):
Section 1. That Section 2, Chapter 568, Volume 17, Laws of Delaware, be and the same is hereby amended by striking out all of the second sentence of Section 2, and inserting in lieu thereof the following:
The Councilmen and President of Council shall be elected on the second Tuesday of January, beginning with the annual election to be held on the second Tuesday in January in 1946, and on the second Tuesday in January annually thereafter, at an election held in some public place selected by the Council for the purpose of holding said annual election within the limits of said town for the election of Councilmen and President of Council for the said Town of Magnolia.
Section 2. That Section 2, Chapter 568, Volume 17, Laws of Delaware, be further amended by striking out all of the fifth sentence of said Section reading as follows:
"The election shall be opened at two o'clock P. M. and closed at four o'clock P. M." and inserting in lieu thereof the following words:
"The election shall be opened at seven o'clock P. M. and closed at nine o'clock P. M."
Section 3. That Section 2 of Chapter 568, Volume 17, Laws of Delaware, be further amended by striking out the word "March" as the same appears in the third line of the ninth sentence in said Section 2 and inserting in lieu thereof the word "December".
Section 4. That Section 12 of said Chapter 568, of Volume 17, Laws of Delaware, be amended by striking out the word "April" as the same appears in the last line of said Section 12 and inserting in lieu thereof the word "January".
Section 5. That Section 20 of said Chapter 568, Volume 17, Laws of Delaware, be amended by striking out the word "April'' as the same appears in the fourth line of said Section 20 and inserting in lieu thereof the word "January".
Section 6. Amend Section 21 of said Chapter 568, Volume 17, Laws of Delaware, by striking out all of the fourth sentence of said Section 21, and inserting in lieu thereof the following:
The council of said town shall, within five days next after receiving said assessment list, cause a full and complete transcript of said assessment list to be hung up in the post office in said town, there to remain for the space of ten days thereafter for public inspection, and the said council shall, on the Tuesday next after the expiration of said ten days, hold a court of appeal, which shall continue open from seven o'clock P. M. till nine o'clock P. M. of said day, when they shall hear and determine appeals from the said assessment and may make corrections or additions to or alterations in the said assessment.
