CHAPTER 211 - OYSTERS AUTHORIZING SALE OF GUARD BOAT "DELAWARE" AND PURCHASE OF NEW BOAT
AN ACT AUTHORIZING AND DIRECTING THE COLLECTOR OF THE OYSTER REVENUE TO SELL THE GUARD BOAT KNOWN AS "DELAWARE" AND TO PURCHASE A BOAT FOR THE EXCLUSIVE USE OF THE COLLECTOR OF THE OYSTER REVENUE AND THE DELAWARE COMMISSION OF SHELL FISHERIES.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That the Collector of the Oyster Revenue be and he hereby is authorized and directed to sell the boat known as the Guard Boat "Delaware" and to this end the said Collector of Oyster Revenue is hereby authorized and directed to advertise said boat for sale in such manner and in such publications and/or newspapers and for such reasonable time as to said Collector may be deemed proper; that at a time fixed by the said Collector in such advertisements, the said Collector shall receive sealed bids from each bidder accompanied by a certified check for the amount of each such bid payable to the State of Delaware.
Section 2. The Collector of the Oyster Revenue shall have the right to reject any and/or all bids so received provided, however, that if the bid of the highest and best bidder is satisfactory to the said Collector he shall make award accordingly and thereupon forward said certified check to the State Treasurer to be by him deposited to the credit of the General Fund of the State; and all checks accompanying bids which are not accepted by said Collector shall promptly be returned to the respective bidders who submitted the same; if all bids are rejected by the said Collector, the said Collector shall again advertise for new sealed bids as aforesaid.
Section 3. After the said Collector of the Oyster Revenue has sold the said Guard Boat "Delaware" as hereinbefore provided, the said Collector of the Oyster Revenue be and he hereby is thereupon authorized and directed to purchase a boat at a price not to exceed the sum of Five Thousand Dollars ($5,000.00) to be used exclusively by the Collector of the Oyster Revenue and the Delaware Commission of Shell Fisheries.
