CHAPTER 218 - TRUSTEES FOR INSANE PERSONS RELATING TO BONDS, RECOGNIZANCES, ACCOUNTS AND ALLOWANCES
AN ACT TO AMEND CHAPTER 76 OF THE REVISED CODE OF DELAWARE, 1935, RELATING TO THE BONDS, RECOGNIZANCES, ACCOUNTS AND ALLOWANCES OF TRUSTEES FOR INSANE PERSONS.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Chapter 76 of the Revised Code of Delaware, 1935, be and the same is hereby amended by striking out and repealing all of 3092. Sec. 27 thereof and inserting in lieu thereof a new Section, to be styled 3092. Sec. 27. as follows:
3092. Sec. 27. Trustees; Bond or Recognizance; Accounts; Allowances:--The trustee shall enter into recognizance or into a bond to be taken in the name of the State with surety, as the Chancellor shall require, for the faithful discharge of his duty; and shall file, with the Register in Chancery of the county in which such appointment is made, and submit to the Chancellor for his approval, accounts showing the receipts and disbursements of the trust property, at such times as the Chancellor shall require, but not oftener than once in two years, unless there be special occasion. In such account the trustee shall be allowed necessary expenses and just compensation for services.
The Chancellor may, at any time, require the trustee to give other or additional recognizance or bond with surety to be approved by the Chancellor; and if such order be not complied with, the Chancellor may remove the trustee from his office.
