CHAPTER 233 - WILLS - LEGAL AGE FOR MAKING WILL
AN ACT TO AMEND CHAPTER 93 OF THE REVISED CODE OF DELAWARE, 1935, RELATING TO WILLS, BY PROVIDING WHO MAY MAKE A WILL.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That 3704. Sec. 2, of Chapter 93, Revised Code of Delaware, 1935, be and the same is hereby amended by striking out all of the said Sec. 2 and substituting in lieu thereof the following section to be known as Section 3704, Sec. 2:
3704. Sec. 2. Who May Make a Will:--Any person of the age of eighteen years, or upwards, of sound and disposing mind and memory, may make a will as well of real as of personal estate. No person, under the age of eighteen years, shall be capable of making a will either of real or personal estate.
