CHAPTER 262 - ALCOHOLIC LIQUOR, WINES AND BEER - LIMITING TIME FOR APPEAL
AN ACT TO AMEND CHAPTER 176 OF THE REVISED CODE OF DELAWARE, 1935, RELATING TO ALCOHOLIC LIQUOR, WINES AND BEER BY LIMITING THE TIME FOR APPEAL UNDER 6151 SEC. 22 OF SAID CHAPTER AND CONFORMING PROCEEDINGS ON APPEAL UNDER 6151 SEC. 22 WITH PROVISIONS OF 6150 SEC. 21, AS AMENDED.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That 6151 Sec. 22 of the Revised Code of Delaware, 1935, be and the same is hereby amended by striking out all of the last grammatical paragraph of said section reading as follows:
"If an application for license be refused, the applicant may appeal to the Court of General Sessions of the County in which he resides and the Court may order the grant of such license."
and by inserting in lieu thereof a new paragraph reading as follows:
"The Commission's decision refusing an application for a license shall be final and conclusive unless within ten days after notice of refusal the applicant shall appeal to the Court of General Sessions of the County in which the license, if granted, would operate. The procedure on such appeal shall be as provided in Section 21 of this Chapter, as amended by Chapter 275, Volume 43, Laws of Delaware, being 6150 Sec. 21 of the Revised Code of Delaware, 1935."
