CHAPTER 265 - ALCOHOLIC LIQUOR, WINES AND BEER REGULATING TIME OF SALE
AN ACT TO AMEND CHAPTER 176 OF THE REVISED CODE OF DELAWARE, 1935, RELATING TO ALCOHOLIC LIQUOR, WINES AND BEERS.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That 6162 Sec. 33 of the Revised Code of Delaware, 1935, be and the same hereby is amended by striking out paragraphs (3) and (4) thereof and by substituting in lieu thereof the following:
(3) It is forbidden for any holder of a license for the sale of "spirits", "wines" or "beer" in a store to sell or deliver the same on any holiday as hereinafter named or in any territory where an election is held during the hours of the day upon which the polling at such election takes place, or before nine o'clock in the morning or after twelve o'clock in the evening of any other day.
(4) It is forbidden for any holder of a license for the sale of "alcoholic liquor" in a "hotel", in a "restaurant", in a "club" or in a "tavern", to sell the same between twelve o'clock midnight of any day and nine o'clock in the forenoon of the following day, provided that the closing hour may be made earlier in any Municipality by ordinance of the Municipal Corporation. It is also forbidden for such person to sell "spirits", "wines" or "beer" on any holiday hereinafter mentioned, or in any territory where an election is held, during the hours of the day upon which the polling at such election takes place.
