CHAPTER 268 - UNEMPLOYMENT COMPENSATION LAW RELATING TO WAGES PAID TO DISABLED OR HANDICAPPED PERSONS

AN ACT TO AMEND AN ACT KNOWN AND CITED AS THE "UNEMPLOYMENT COMPENSATION LAW", BEING CHAPTER 258, VOLUME 41, LAWS OF DELAWARE, 1937, AS AMENDED, BY PROVIDING THAT WAGES PAID TO A "DISABLED" OR "HANDICAPPED" EMPLOYEE UNDER CERTAIN CONDITIONS SHALL NOT BE USED AS A BASIS FOR A BENEFIT WAGE CHARGE.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Section 7 (c) (2) (A) of Chapter 258, Volume 41, Laws of Delaware, 1937, as amended, (known and cited as the "Unemployment Compensation Law"), be and the same is hereby amended by adding thereto a new and additional sentence, reading as follows:

Provided, however, that wages paid by any individual employer to an employee during the first ninety days such employee is in employment for him shall not be considered in determining benefit wages if the said employee is rated as "disabled" by the United States Veterans Administration or as "handicapped" by the State Board of Vocational Education.

Section 2. This act will become effective immediately.
