CHAPTER 270 - STATE HIGHWAY DEPARTMENT RELATING TO JURISDICTION OUTSIDE INCORPORATED TOWNS; DESIGNATING ONE WAY HIGHWAYS
AN ACT TO AMEND CHAPTER 166 OF THE REVISED CODE OF DELAWARE, 1935, AS AMENDED, RELATING TO THE STATE HIGHWAY DEPARTMENT BY PROVIDING FOR THE JURISDICTION OF SAID DEPARTMENT OUTSIDE INCORPORATED TOWNS; PROVIDING FOR THE ADOPTION OF CERTAIN RULES AND REGULATIONS PERTAINING TO TRAFFIC WITH CERTAIN LIMITATIONS; PROVIDING THAT THE DEPARTMENT MAY DESIGNATE DUAL OR DIVIDED HIGHWAYS AS ONE WAY HIGHWAYS AND FIX DIRECTION OF TRAVEL THEREON AND FOR THE ERECTION OF APPROPRIATE SIGNS.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Chapter 166 of the Revised Code of Delaware, 1935, as amended, be further amended by striking out and repealing all of 5758 Section 39 thereof and substituting in lieu thereof a new section to be known as 5758 Section 39 thereof as follows:
5758. Sec. 39. Jurisdiction Outside Incorporated Towns; May Adopt Rules. and Regulations; Limitations; Establish One Way Highways and Fix Direction of Travel; Signs:--(a) The department shall have jurisdiction and control of all State highways of the State outside of the limits of incorporated cities and towns for the purpose of regulating traffic and the use and operation of all vehicles thereover; and may adopt any and all reasonable rules and regulations respecting the use of such highways and the operation of all vehicles upon the same; provided, however, that nothing in this article shall be construed as granting to said department the right to make any rules and regulations respecting the use of said highways inconsistent with any Act or Acts of the General Assembly now in force or hereafter to be passed.
(b) Whenever dual or divided highways have been constructed by the State Highway Department, the said Department may designate such highways as one way highways by fixing the direction of travel and passage over the same for pedestrians and vehicles of whatsoever character. All one way highways shall be plainly marked as such by said Department by the erection of appropriate signs, showing the direction permissible for travel and passage over the same; said signs shall be placed by said Department at all intersections of such highways so as to be plainly visible by persons entering such one way highways.
