CHAPTER 52.
OF THE LEVY COURT.
Amend Senate Bill No. 52, entitled "An Act to amend Chapter 22, Volume 21, Laws of Delaware, entitled 'An Act reorganizing the Levy Court of Kent County and defining its powers and duties."
By striking out the word "five" in line fifteen of Section the bill, and inserting in lieu thereof the word "six."
Amend said Senate Bill No. 52 further as follows, viz.:
By striking out all of Section 2 of said bill after the word "words" in line five thereof and inserting in lieu thereof the following, viz.: "Elected to" in line two of Section 12, and by inserting the word "of" in lieu of said words "Elected to" so stricken out.
Amend said Senate Bill No. 52 further by adding at the end
thereof the following, viz.:
"Section 3. That from and after the approval of this Act the person now holding the office of Clerk of the Peace of Kent County, or who shall hereafter hold said office, shall ex-officio be a member of the Levy Court of Kent County and one of the Commissioners thereof, and shall have the right and power to exercise and enjoy all the duties, powers and privileges which under the laws of this State any duly qualified member of the Levy Court of Kent County may or can exercise or enjoy; provided, that he shall receive no compensation as a member or Commissioner of said Levy Court or be eligible for the Presidency thereof."
An Act To Amend Chapter 22, Volume 21, 01".111e Laws Of Delaware, Entitled "An Act Reorganizing The Levy Court Of Kent County, And Defining Its Powers And Duties."
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Section 5, of Chapter 22, as printed and published in Volume 21, Laws of Delaware, entitled "An Act reorganizing the Levy Court of Kent County, and defining its powers and duties," be and the same is hereby amended by striking out of lines nine and ten of said Section the following words, viz.: "all the members of said Levy Court being present and voting." That said Section 5 of said Chapter 22, as printed and published in Volume 21, Laws of Delaware, entitled "An Act reorganizing the Levy Court of Kent County, and defining its powers and duties," be further amended by striking out the words "six of said" in line thirteen of said Section 5, and by inserting in lieu thereof the words "That at any time five of the."
Section 2. That Section 12 of said Chapter 22, as printed and published in Volume 21, Laws of Delaware, entitled "An Act reorganizing the Levy Court of Kent County, and defining its powers and duties," be amended by striking out the words "a majority of all the " in line one of said Section 12 and by inserting in lieu thereof the word "five."
