CHAPTER 74
Of Delaware State Tuberculosis Commission.
AN ACT CREATING THE DELAWARE STATE TUBERCULOSIS COMMISSION.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. The Delaware State Tuberculosis Commission is hereby created, constituted for the purposes and with the powers and duties hereinafter provided.
Section 2. The Delaware State Tuberculosis Commission shall consist of nine members, three from each County, who shall be appointed by the Governor. Their term of office shall be for three years. Upon the appointment of the original Commission the Governor shall from each of the Counties designate one person to serve for one year, one person to serve for two years, and one .person to serve for three years. Upon the expiration of the terms of the original appointees their successors shall be appointed for a term of three years. The Governor shall have power to fill all vacancies caused by death, resignation or otherwise, and appointments to fill such vacancies shall be for the balance of the unexpired term. The appointments of the original members of the Commission shall be from April first, nineteen hundred and nine.
Section 3. The members of the Commission shall receive no salary for their services. The members of the Commission shall annually elect one of their number as Chairman of said Commission, and may appoint a person as Secretary, who may receive a salary not exceeding One Hundred and Fifty dollars per annum.
Section 4. The Commission shall have power and are hereby authorized to send such indigent consumptive patients as require treatment to sanatoriums for such treatment. Said Commission shall pay for the care, treatment and support of such patients only the actual cost of their maintenance in said sanatoriums, and shall report to the Governor, quarterly, their actions in this matter. Persons in indigent circumstances who, in the judgment of the Commission, are able themselves or by their relatives to pay part of said cost of maintenance may be admitted to said sanatoriums and maintained and treated therein at the expense of the State, to the extent that they cannot by themselves or relatives chargeable therefor pay such cost of maintenance.
Section 5. The Commission is hereby authorized and directed to establish throughout the State at least one dispensary in each County for the treatment of indigent consumptive patients, and for the purpose of maintaining such dispensaries employ such qualified persons as may be necessary to take charge thereof, and to pay them such reasonable compensation as may be necessary.
Section 6. The Commission shall furnish annually to the Governor, during the first week in January, a full account of their expenditures and disbursements. They shall also at the same time report to the Governor the work of the Commission for the year, including the number of persons treated, the results of treatment, as nearly as can be ascertained, and such other information as may be of public interest and value. Such report shall at all times be open to the inspection of the citizens of the State in the office of the Secretary of State.
Section 7. To defray the expense of the Commission the sum of Fifteen Thousand Dollars is hereby appropriated annually out of the money in the State Treasury not otherwise appropriated; and the State Treasurer is hereby authorized, from time to time, to pay out of such amount upon the requisition of the Chairman of the Commission.
