CHAPTER 234

Of Pleading and Practice in Civil Actions.

AN ACT TO AMEND CHAPTER 594, VOLUME 20, LAWS OF DELAWARE, ENTITLED "AN ACT IN RELATION TO PLEADING AND PRACTICE."

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 594, Volume 20, Laws of Delaware, entitled An Act in relation to Pleading and Practice," be and the same is .hereby amended by striking out all of Section 2 of said Chapter and inserting in lieu thereof the following new Section 2, to wit:

"Section 2. That if after a cause of action shall have accrued against any person, he shall depart from and remain out of this State, the time of his absence, until he shall have returned into this State in such manner that, by reasonable diligence, he may be served with process, shall not be taken as any part of the time limited for the commencement of the action."
