CHAPTER 196
HUSBAND AND WIFE
AN ACT to amend Chapter 87 of the Revised Code of Delaware relating to Husband and Wife.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: That Chapter 87 of the Revised Code of the State of Delaware be and the same is hereby amended by striking out 3040 Section 8 of said Chapter, and inserting in lieu thereof the following new section, to be known as 3040 Section 8.
"3040. Section 8. VIOLATION OF PROBATION ORDER; PROCEEDINGS UPON; FORFEITED RECOGNIZANCE; PROCEEDS OF HOW APPLIED: If the Court be satisfied by information and due proof under oath that the defendant has violated the terms of such order, it may forthwith proceed with the trial of the defendant, or sentence him under the original conviction, or enforce the suspended sentence, as the case may be. In case of forfeiture of a recognizance, and the enforcement thereof by execution, the sum recovered may, in the discretion of the Court, be paid in whole or in part to the wife, or the guardian, custodian or trustee of the said minor child or children."
