AN ACT TO AMEND THE CHARTER OF THE TOWN OF FREDERICA.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend § 17 of the Charter of the Town of Frederica by making deletions as shown by strike through and insertions as shown by underline as follows:
o) Notwithstanding anything herein to the contrary, the Town Manager of the Town of Frederica shall have all of the powers and authority conferred upon or vested in the Receiver of Taxes and County Treasurer for Kent County as set forth in 9 Del. C. Ch. 87 as it may, from time-to-time hereafter, be amended (or in accordance with any future corresponding provision of law) shall be deemed and held to apply to all taxes levied and imposed under the provisions of this Charter. In effecting a collection of any delinquent tax or any other charges, costs, or assessments due to the Town and added to the tax assessment list, the Town Council may recover the costs of collection, including all court costs, sale costs, reasonable and necessary out-of-pocket expenses, and reasonable attorney’s fees incurred by the Town in the collection proceedings.
