AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO THE PENALTIES FOR FAILING TO REPORT SUSPECTED CHILD ABUSE OR NEGLECT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend §914, Title 16 of the Delaware Code, in its entirety by striking §914 and by substituting in lieu thereof:
"§914. Penalty for violation.
(a) Whoever violates §903 of this Title shall be liable for a civil penalty not to exceed $5,000 for the first violation, and not to exceed $50,000 for any subsequent violation.
(b) In any action brought under this section, if the court finds a violation, the court may award costs and attorneys fees."
