CHAPTER 13 - OCCUPATIONAL LICENSES - RELATING TO COIN OPERATED MUSICAL MACHINES
AN ACT TO AMEND CHAPTER 6 OF THE REVISED CODE OF DELAWARE, 1935, ENTITLED "STATE REVENUE", BY PROVIDING FOR THE LICENSING OF COIN OPERATED AMUSEMENT AND MUSICAL MACHINES.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Chapter 6 of the Revised Code of Delaware, 1935, as amended by Chapter 67, Volume 42, Laws of Delaware, be and the same is hereby amended by adding at the end of Section 4 of said Chapter 67, Volume 42, Laws of Delaware, a new paragraph, as follows:
Coin Operated Amusement Machine Owner, Ten Dollars ($10.00). Coin Operated Amusement Machine Owner shall include every person engaged in the business of owning and operating on his own account or by his agent, or leasing to or placing with another on a commission or other basis any coin operated machine, device or table upon or by means of which games are played by the general public for amusement and entertainment, but not for money or other thing of value, and shall pay, in addition to the license fee required for engaging in such business, a fee for license for each coin operated amusement machine so owned and operated according to the following rates: All machines having a device in which a penny is required or may be used to operate the machine, Five Dollars ($5.00); all machines having a device in which a nickel or coin of larger denomination is required or may be used to operate the machine, Ten Dollars ($10.00).
Section 2. That Chapter 6 of the Revised Code of Delaware, 1935, as amended by Chapter 67, Volume 42, Laws of Delaware, be and the same is hereby further amended by striking out all of paragraph (c) in Section 1 of said Chapter 67, Volume 42, Laws of Delaware, and inserting in lieu thereof a new paragraph to be known as paragraph (c), as follows:
(c) Music Machine Owner embracing every person engaged in the business of owning and operating either on his own account or by his agent, or by lease to another from such person or his agent, certain mechanical devices hereinbefore referred to for furnishing to the public, music by the playing of records or transcriptions and shall pay a fee for a license at the rate of Ten Dollars ($10.00) for each machine so owned and operated.
