AN ACT TO AMEND TITLE 12 OF THE DELAWARE CODE RELATING TO ISSUANCE OF SMALL ESTATE AFFIDAVITS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §2306(a), Title 12 of the Delaware Code by deleting the phrase "issued by the Register of Wills", as found in the introductory paragraph of that subsection.
Section 2. Amend §2306, Title 12 of the Delaware Code by adding a new subsection (d) to read as follows:
"(d) Nothing in subsection (a) of this section shall preclude the Register of Wills from issuing an affidavit when and where appropriate."
