CHAPTER 154

CHILDREN'S BUREAU OF DELAWARE

AN ACT amending Chapter 70 of the Revised Code of the State of Delaware relating to Reformatory and Charitable Institutions. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met (two-thirds of all the members elected to each House concurring therein) as follows, to-wit:

Section 1. That Chapter 70 of the Revised Code of the State of Delaware be and the same is hereby amended by repealing 2214 Sec. 23 thereunder and by inserting in lieu thereof the following:

2214 Sec. 23. CHILDREN'S BUREAU OF DELAWARE; AMENDMENT TO CHARTER OF THE DELAWARE SOCIETY FOR THE PRE- VENTION OF CRUELTY TO CHILDREN; POWERS: The Delaware Society for the Prevention of Cruelty to Children shall hereafter. be known by the name and title of "Children's Bureau of Delaware" and by that name is continued the corporation and body politic and corporate in law, and by that name shall be able and capable in law to sue and be sued, plead and be impleaded in any courts of law or equity in this State or elsewhere, in any manner of suits, complaints, pleas, causes and demands whatsoever, with all the legal incidents of a corporation aggregate, including the right to use a common seal, the same at their pleasure to alter and renew, to receive legacies and donations and to hold real estate not exceeding in value the sum of One Hundred Thousand Dollars and by the title aforesaid shall have perpetual continuance and succession.

Section 2. That the said Chapter 70 of the Revised Code of the State of Delaware be and the same is further amended by repealing 2215 Sec. 24 and by inserting in lieu thereof the following: 2215 Sec. 24. OBJECTS OF THE BUREAU:- The objects of the Children's Bureau of Delaware are to provide effective means for the prevention of cruelty to children throughout the State of Delaware, and for the enforcement of all laws heretofore or hereafter enacted for the protection of children; to purchase, print, publish and circulate such tracts and books as are fitted to promote the objects of the Bureau ; to appoint and employ such agents as the Board of Managers may, from time to time deem necessary ; to improve the condition of children in the State of Delaware by rendering service to them in their homes and other- wise providing for those in need of special care; to initiate and execute plans for the general welfare of children, and to co- operate with any other charitable organization, commission or agency engaged in such work; to accept the care and custody of children and to perform the lawful acts incident thereto under the provisions of Article 3 of Chapter 88 of the Revised Code of the State of Delaware and under the provisions of Article 2 of Chapter 116 of the said Revised Code and to accept the care and custody of children by direction or commitment of any court, judge or officer of competent jurisdiction within the State of Delaware.

Section 3. That said Chapter 70 of the Revised Code of the State of Delaware be and the same is further amended by repealing 2216 Sec. 25 and by inserting in lieu thereof the following: 2216 Sec. 25. OFFICERS:- The officers of the corporation shall be a president, such number of vice-presidents as the by- laws of the corporation may prescribe, a secretary, a treasurer and a board of managers, the number of whom shall be, from time to time, fixed by the by-laws. The board of managers shall have the control and management of the affairs of the said corporation and may appoint such other officers and agents as may be necessary for the transaction of the business of the Bureau.

Section 4. That said Chapter 70 of the Revised Code of the State of Delaware be and the same is further amended by re- pealing 2217 Sec. 26 and by inserting in lieu thereof the following:

2217 Sec. 26. ANNUAL ELECTION; WHEN HELD; NOTICE. OF; TERMS OF OFFICE; QUALIFICATION OF ELECTORS: In the month of February in each year the election of officers and man- agers of the said Bureau shall be held in the City of Wilmington, at such time and place, and after such notice as the managers for the time being may deem proper. The said meeting may be adjourned from time to time and the officers and managers shall continue to act until their successors have been duly elected. At all such elections the officers and members of the board of man- agers shall each be entitled to cast one vote. Until the next annual election, the officers and board of managers shall be as follows:

Section 5. That said Chapter 70 of the Revised Code of the State of Delaware be and the same is further amended by re- pealing 2218 Sec. 27 and by inserting in lieu thereof the following:

2218 Sec. 27. BY-LAWS. The board-of managers of the said Children's Bureau of Delaware shall have power and authority to adopt, amend or rescind by-laws, fixing and altering the number of vice-presidents, the number and qualifications of its man- agers, the number to be necessary at any meeting of the managers to constitute a quorum for the transaction of business, for the conduct of elections and for the general regulation and management of its affairs.

Section 6. That said Chapter 70 of the Revised Code of the State of Delaware be and the same is further amended by repealing 2219 Sec. 28 and by inserting in lieu thereof the following:

2219 Sec. 28. ENFORCEMENT OF LAWS FOR PROTECTION OF CHILDREN; PEACE OFFICERS SHALL ASSIST THE BUREAU: The Sheriffs and Constables of the several counties of this State, the police officers of the City of Wilmington, as well as all other places in the State of Delaware where police organizations or officers having police powers may exist, shall, as occasion may require, assist the Bureau, its officers or agents, in the enforcement of all laws which are at any time in force for the protection of children.

Section 7. That said Chapter 70 of the Revised Code of the State of Delaware be and the same is further amended by re- pealing 2220 Sec. 29 and by inserting in lieu thereof the following: 2220 Sec. 29. OFFICES. The principal office of the Bureau shall be located in the City of Wilmington with full power on the part of the Bureau to establish and locate branch offices at any place, or places, within the boundaries of the State.

Section 8. That said Chapter 70 of the Revised Code of the State of Delaware be and the same is further amended by repealing 2221 Sec. 30 and by inserting in lieu thereof the following: 2221 Sec. 30. FINES AND FORFEITURES TO INURE TO BUREAU UPON PROSECUTIONS BY IT; APPROPRIATIONS; FROM STATE; FROM LEVY COURTS OF THE SEVERAL COUNTIES: All the fines, penalties and forfeitures imposed and collected in any County of this State, under the provisions of every act relating to or affecting children, in every case where the prosecution shall be instituted and conducted by the Children's Bureau of Delaware, shall inure and be paid to the said Bureau in aid of the purposes for which it is incorporated. The Levy Court of each County shall have authority to make an appropriation, or appropriations, annually to the Children's Bureau of Delaware in aid of the objects of the said corporation. The sum of Ten Dollars is annually appropriated to the Children's Bureau of Delaware to be paid by the State Treasurer in accordance with the provisions of Section 20 of Chapter 15, upon the warrants of said corporation. The said sum so appropriated shall be used in providing effective means for the prevention of cruelty to children throughout the State of Delaware and for the enforcement of all laws in relation thereto.

Section 9. That said Chapter 70 of the Revised Code of the State of Delaware be and the same is hereby further amended by adding a new section to be known as 2221 Sec. 30-a, as follows, to-wit: 2221 Sec. 30-a. Wherever in any statute of the State of Delaware law, ordinance, or resolution, the words "The Delaware Society for the Prevention of Cruelty to Children" shall appear, there is hereby substituted therefor the words "Children's Bureau of Delaware," and by the said name the said corporation shall succeed to and be possessed of all of the property, real or personal, moneys, rights and effects now belonging to or vested in, or hereafter coming to the said The Delaware Society for the Prevention of Cruelty to Children, the intention and purpose of this amendment being to amend the charter of the said The Delaware Society for the Prevention of Cruelty to Children as herein provided.
