CHAPTER 183
FISH, OYSTERS AND GAME
AN ACT to amend Chapter 74 of the Revised Code of the State of Delaware in relation to the Killing of Muskrats. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Chapter 74 of the Revised Code of the State of Delaware be, and the same is hereby amended by inserting immediately after paragraph 2388 B. Section 31 B. a new paragraph to be known as 2388 C. Section 31 C. as follows:
2388 C. Section 31 C. MUSKRATS DIVING TRAPS; UNLAWFUL: It shall be unlawful to take, capture or kill, at any time, within the State of Delaware, any Muskrats or Muskrat, with a trap commonly known as a diving or box trap. The setting of any such trap in any Muskrat den, lead, or runway 'shall be prima facia evidence of an offense against this Act.
Section 2. Whoever, shall in any way violate any of the provisions of this Act shall be guilty of a misdemeanor, and upon conviction thereof, before any Justice of the Peace of the County in which the crime is committed, shall be fined not less than Twenty-five dollars ($25.00) nor more than Fifty dollars ($50.00) for each and every offense, and in default of the payment of such fine and costs, shall be imprisoned for not less than thirty days or both.
