AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO COMMERCIAL DRIVERS LICENSES AND THE LENGTH OF ISSUANCE FOR A COMMERCIAL DRIVER'S LICENSE WITH A HAZARDOUS MATERIALS ENDORSEMENT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §2611(e), Title 21 of the Delaware Code, by adding to the end of this subsection a new sentence to read as follows:
“Notwithstanding the provisions of the first sentence of this subsection, the Secretary may issue a commercial motor vehicle driver’s license endorsed for the transport of hazardous materials for a period of less than 5 years to coincide with the expiration of the Transportation Security Administration approval for the driver to transport hazardous materials. The license shall expire on the driver’s last birthday prior to the expiration of the hazardous materials endorsement.”
Section 2. Amend §2715(e), Title 21 of the Delaware Code, by striking the entire subsection and replacing in lieu thereof the following:
“(e) Notwithstanding the length of issuance and fees as stated in this subsection, the length of issuance and fees for commercial motor vehicle driver’s licenses as required in Chapter 26 of this Title shall be as required in §2611.”
