AN ACT TO AMEND THE LAWS OF DELAWARE SPECIFYING CERTAIN CONDITIONS FOR THE EXPENDITURE OF CAPITAL IMPROVEMENT FUNDS AND TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO CERTAIN COMMITTEE APPOINTMENTS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Market Pressure Fund Transfers. 75 Del. Laws, c. 90, §2 appropriates monies for the Market Pressure Fund and 75 Del. Laws, c. 230, §11 appropriates funds for the School Construction Market Pressure Fund. Notwithstanding any law or other provision to the contrary, the Department of Education, with the approval of the Director of the Office of Management and Budget and the Controller General, may transfer funding between the major capital construction projects within the respective school districts. These transfers shall not authorize any changes in conditions or incur any obligations in excess of the approved Certificate(s) of Necessity.
Section 2. Wrangle Hill Realignment – Colonial School District. The Section 1 Addendum to 75 Del. Laws c. 353 appropriates $800,000 for Wrangle Hill Elementary School Realignment. The following funds may be used to meet the required local match: Minor Capital Improvement Funds, Division III Equalization, Voluntary Assessment Funds and/or local funds raised in excess of those required on the Certificate of Necessity issued by the Department of Education for the Wrangle Hill Elementary School Project. The district shall notify the Department of Education, Office of the Controller General and the Office of Management and Budget which option it has chosen.
Section 3. Subdivision Entrance Signage. Decorative entrance subdivision signs placed in clear zones before the adoption of implementing regulations under 17 Del.C. Section 508 regarding such signs shall be permitted to remain in place, until replaced with signs that comply with Department standards for breakaway and other safety considerations. Routine renovations, maintenance and upgrades to existing signage may continue without triggering replacement responsibilities.
Section 4. Port of Wilmington. Amend 29 Del. C. §8781(b) by adding after the words “Co-Chairs of the General Assembly’s Joint Legislative Committee on the Capital Improvement Program” the words “or their designee(s)”.
Section 5. Livable Delaware Advisory Council. Amend 29 Del. C. §9102 (c) (6) by adding after the words “co-chairs of the Joint Bond Bill Committee” the words “or their designee(s)”.
