AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO THE DEPARTMENT OF HEALTH AND SOCIAL SERVICES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 1, Title 16, Delaware Code by adding a new section to read as follows:

"§ 111. Retaliation or discrimination against complainants; immunities and other protections.

Notwithstanding any law or regulation to the contrary, any psychiatric nursing or treatment facility owned by or operated by the Department shall be subject to the provisions of § 1117, § 1135 and § 1154 whether or not such facility is licensed as a long term care facility.".
