CHAPTER 264.

OF PARENTS AND CHILDREN.

AN ACT in relation to the changing of Names of residents of the State of Delaware.

Be it enacted by the Senate and House of Representatives of the State of Delaware, in General Assembly met:

Section 1. After the approval of this act any person who shall desire to have his or her name changed shall present a petition duly verified to the Superior Court sitting in the county in which such person resides setting forth such person's name, and the name he or she desires to assume.

Section 2. If the name sought to be changed be that of a minor, the said petition shall be signed by at least one of said minor's parents if there be a parent living, or if both parents be dead, by the legal guardian of such minor, and when the minor shall be over the age of fourteen, the said petition shall also be signed by the said minor.

Section 3. No such petition shall be granted unless it affirmatively appears that the said petition has been published in a newspaper published in the county in which such proceeding is had, at least once a week for three weeks before the said petition is filed.

Section 4. Upon presentation of said petition and it appearing that the requirements of this act have been fully complied with, and there appearing no reason for not granting the said petition, the prayer of the said petition may be granted.

Costs Section 5. The costs of the proceedings shall be paid by the petitioner or petitioners.
