CHAPTER 271
OF PILOTAGE, NAVIGATION AND VESSELS.
AN ACT TO AMEND CHAPTER 449 OF VOLUME 16, LAWS OF DELAWARE, ENTITLED "AN ACT REGULATING PILOTS AND PILOTAGE OF AND IN THE BAY AND RIVER DELAWARE,"
AS THE SAME HAS BEEN AMENDED, REGULATING THE LICENSE OF PILOTS AND CHANGING THE RATES FOR PILOTAGE.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
SECTION 1. That Chapter 449, of Volume 16, Laws of Delaware, as the same has been amended, be and the same is hereby amended by striking out Section 3 thereof and inserting in lieu thereof the following, viz:
"SECTION 3. That no license of the first or second class shall be granted to any person or persons except such persons as have heretofore held or do now hold such license under the laws of this State, or shall have served a regular apprenticeship of at least six years to a licensed pilot of this State, on board of a Delaware Bay or River pilot boat, nor shall any license be granted until the person applying shall have given bond, with sufficient surety, to the Governor of this State in a sum not exceeding five hundred dollars, conditioned for the true and faithful performance of the duties and services required by this Act and that he will not aid or assist in violating the Revenue Laws of the United States, and that he will deliver up the license to him granted when required by the Board in pursuance of the provisions of this Act, nor shall any first class license be granted to any person until the number of first class pilots licensed under the laws of this State shall have been reduced to forty, and thereafter such number of forty shall not be exceeded. The whole number of second class licensed pilots shall not exceed ten at any one time. Whenever and as often as a vacancy shall occur by reason of the number of first class pilots being reduced to less than forty) a license shall be granted to the senior second class pilot who is duly qualified under the laws of this State; provided, that no person shall be entitled to a license as pilot for any branch without first having under the immediate inspection of his master la pilot of the first class conducted a square-rigged vessel twenty times up and twenty times down the river and bay."
SECTION 2, That said Chapter 449 of Volume 16, Laws of Delaware, as the same has been amended, be and the same is further amended by striking out Section 18 thereof and inserting in lieu thereof the following, viz:
"SECTION 18 . The rates of pilotage for conducting a vessel from the Capes of the Delaware to the City of Philadelphia or other place on the River Delaware, and from the City of Philadelphia or other place on the River Delaware to the Capes of the Delaware in either case shall be for every half foot of water which a vessel shall draw under, up to and including twelve feet, the sum of two dollars per half foot, and for every vessel drawing over twelve feet the sum of two dollars and fifty cents per half foot
Deduction, of water. A deduction of ten per centum from the said rates shall be made when an inward bound vessel is first spoken by the pilot inside of a straight line drawn from Cape Henlopen Light to Cape
May Light. Every such vessel bound to the Breakwater for orders shall pay pilotage fees as follows: A. stun equal to one-half of the inward rates of pilotage to the Port of Philadelphia, and the same fees when outward bound from the Breakwater."
SECTION 3. That all laws and parts heretofore passed inconsistent with the provisions of this Act are hereby repealed.
