AN ACT TO AMEND CHAPTER 56, TITLE 29 DELAWARE CODE RELATING TO ELIGIBILITY FOR RETIREMENT UNDER THE STATE JUDICIAL PENSION PLAN.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §5602(b), Chapter 56, Title 29 Delaware Code by striking said subsection in its entirety and substituting in lieu thereof a new subsection (b) to read as follows:
"(b) Each member covered by the closed plan shall, upon his retirement from the state judiciary; whether voluntary or involuntary; after serving at least 24 years as a judge, or who is involuntarily retired after having served 22 years as a judge, including all years of judicial service in Delaware of the retiring judge both prior and subsequent to his becoming a member of the state judiciary and both prior and subsequent to his filing a declaration of acceptance of the provisions of this chapter in accordance with §5605 of this title; or after having reached the age of 65 years and having served at least 12 years as a judge, receive an annual pension from the State; payable to him in equal monthly installments, commencing upon the date of retirement and continuing during the remainder of his lifetime."
Section 2. Amend §5612(a), Chapter 56, Title 29 Delaware Code by adding thereto a new subsection (3) to read as follows:
"(3) been involuntarily retired after having served 22 years as a judge."
