AN ACT TO AMEND CHAPTER 5, TITLE 11 OF THE DELAWARE CODE RELATING TO SEXUAL OFFENSES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
SECTION 1. Amend Chapter 5, Title 11 of the Delaware Code by adding a new section to read as follows:
1776. Sexual extortion; Class E felony.
A person is guilty of sexual extortion when he or she intentionally compels or induces another person to engage in any sexual act involving contact, penetration or intercourse with himself or herself or another or others by means of instilling in him or her a fear that, If such sexual act is not performed, the defendant or another will:
cause physical injury to anyone; or
cause damage to property; or
engage in other conduct constituting a crime; or
accuse anyone of a crime or cause criminal charges to be instituted against him or her; or
expose a secret or publicize an asserted fact, whether true or false, intending to subject anyone to hatred, contempt or ridicule; or
falsely testify or provide information or withhold testimony or information with respect another's legal claim or defense; or
perform any other act which is calculated to harm another person materially with respect to his or her health, safety, business, calling, career, financial condition, reputation or personal relationships.
Sexual exploitation is a Class E felony."
