AN ACT TO AMEND PART VI, CHAPTER 61, TITLE 29, DELAWARE CODE, RELATING TO CERTAIN TUITION PAYMENTS COLLECTED BY DELAWARE TECHNICAL AND COMMUNITY COLLEGE.

Be it enacted by the General Assembly of the State of Delaware:

Section 1. Amend §6102 of Chapter 61, Title 29, Delaware Code, by adding a new paragraph (h) to read as follows:

"(h) All Continuing Education Division tuition payments and fees collected by Delaware Technical and Community College shall be deposited into a special fund account known as the Delaware Technical and Community College Continuing Education Division Tuition Fund. The monies in this special fund account shall not be a part of the General Fund and shall only be expended for tuition refunds, salaries and wages, Other Employment Costs (fringe benefits), and operational expenses of the Delaware Technical and Community College Continuing Education Division."

Section 2. Delaware Technical and Community College is hereby authorized to expend the Continuing Education tuition payments and fees, which have been accruing in an escrow account since December 1, 1975, and up to the effective date of this Act, in the following priority order:

(a) Reimburse the appropriate General Fund accounts for Salaries and Wages, Contractual Services, Supplies and Materials expended since December 1, 1975, in connection with the operation of the Continuing Education Division; and

(b) Make other payments or tuition refunds, salaries and wages, Other Employment Costs (fringe benefits), and operational expenses of the Delaware Technical and Community College Continuing Education Division.

Section 3. Delaware Technical and Community College is hereby authorized to transfer any part or portion of the escrowed funds which have been reimbursed to the appropriate General Fund accounts as required by Section 2 (a) of this Act and which funds are unexpended, to the appropriate Campus Contractual Services line item for the purpose of defraying costs of utility services. Such transfer may be made upon approval of the Budget Director and the Controller General.

Section 4. This Act shall become law upon signature of the Governor.
