CHAPTER 411.
AN ACT to protect the people from the dangers resulting from the use of Petroleum, Coal Oils, and Burning Fluids.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met,
[SECTION] 1. That on and after the first day of July next, it shall be unlawful for any person to sell, or offer for sale, within the limits of this State, any petroleum, coal oil, or burning fluid which will not bear the fire test of at least one hundred and ten Fahrenheit (110) degrees Fahrenheit without ignition or explosion.
SECTION 2. That it shall not be lawful for any person to sell coal any petroleum oil, or burning fluid, which has not the government or state inspector's certificate duly affixed to the head of barrel containing the same, and his bill for the same, furnished by the party of whom it was purchased shall be required in all cases to state that such oil or burning fluid is warranted to be of one hundred and ten degrees fire test at least, and any person violating the provisions of this act shall be guilty of a misdemeanor and upon indictment and conviction thereof shall be fined not exceeding one hundred dollars.
SECTION 3. That if any person shall sustain damage to his property or injury to his person by reason of a violation of any of the provisions of this act by another person, the person guilty of said violation shall be liable to the person injured for damages sustained thereby.
